Agreement to Terms
Welcome to EatIn. These Terms of Use ("Terms") govern your access to and use of the EatIn mobile application ("App") operated by EatIn ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.
Description of Service
EatIn is a meal planning and recipe management application that allows users to:
- Extract and save recipes from various sources including websites, Instagram, TikTok, and photos
- Browse a curated library of recipes
- Create weekly meal plans
- Generate shopping lists from planned meals
- Save and organize favorite recipes
User Accounts
Account Creation
To use certain features of the App, you may need to create an account using Apple Sign-In, Google Sign-In, or continue as a guest. You are responsible for maintaining the confidentiality of your account credentials.
Account Responsibilities
You agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
Acceptable Use
You agree not to use the App to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Upload malicious content or attempt to compromise the App's security
- Scrape or extract content in violation of third-party terms of service
- Use the service for any commercial purpose without authorization
- Interfere with or disrupt the App or its servers
- Attempt to gain unauthorized access to any part of the App
Recipe Content
User-Imported Recipes
When you extract recipes from external sources, you are responsible for ensuring you have the right to use and store such content for personal use. EatIn facilitates recipe extraction for personal, non-commercial use only.
Curated Recipe Library
The recipes provided in our curated library are for your personal use within the App. You may not redistribute, republish, or commercially exploit these recipes without our written consent.
Recipe Accuracy
While we strive for accuracy in AI-extracted recipes, we cannot guarantee that all extracted information will be complete or error-free. Always use your judgment when preparing meals, especially regarding allergens, cooking times, and food safety.
Intellectual Property
The App, including its original content (excluding user-provided content), features, and functionality, is owned by EatIn and is protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Subscriptions and Payments
Some features of the App may require a paid subscription. If you choose to subscribe:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
- Refunds are subject to Apple's refund policies
Disclaimers
Service Availability
The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the App.
Dietary and Health Information
Recipe information, including nutritional data, dietary tags, and allergen information, is provided for informational purposes only. EatIn is not responsible for any adverse reactions, health issues, or other consequences resulting from following recipes or meal plans. Always consult with a healthcare professional regarding dietary concerns.
Third-Party Content
We are not responsible for the accuracy, completeness, or reliability of content extracted from third-party sources.
Limitation of Liability
To the maximum extent permitted by law, EatIn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers
- Any errors or omissions in any content
- Any third-party content or conduct
Indemnification
You agree to defend, indemnify, and hold harmless EatIn and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the App or violation of these Terms.
Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account and associated data
- Provisions that should survive termination will remain in effect
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, providing notice through the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
Dispute Resolution
Any disputes arising from these Terms or your use of the App will first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes will be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
